Timeline
Though every case is different, there is a general pattern to the
prosecution of criminal cases. At Kaine & Jones, LLC, we are experienced
in every phase of the criminal process. Below is a brief overview of the
overall process.
Upon arrest you will be taken to the local jail (unless a citation
is issued by the officer in liu of arrest) you will be photographed,
booked and fingerprinted.
Within 48 hours of arrest you will be brought before a Magistrate
Judge for your First Appearance Hearing. At this time your identity
will be confirmed and you will be made aware of the charges brought
against you and if there is a bond available.
Next, you will have an arraignment. This is one of the most important
stages. Here is where you are put on formal notice of what charges
you are facing. Also, there is a 10 day time limit on filing any
motions in your defense.
Next, if the proper motions are filled, there is a period of time where the state must turn over any exculpatory evidence to your attorney. Usually this is no less than 10 days before trial. Also during this time there is usually a pre-trial conference between the Judge, the Prosecutor and your Attorney. Here your case is discussed and negioations are held. If the negioations are successful, the case will be resolved.
If the case is not resolved there is a calendar call where your lawyer will announce your intentions. If matters are unresolved at that time, the next stage is resolution by trial, either bench or jury. The total length of time involved varies from jurisdiction to jurisdiction.
