Wrongful Death - A wrongful death is any death that was directly or indirectly caused by negligence, willful conduct, or indifference to the safety of others. Who Can File a Wrongful Death Claim?

  • Under Georgia law, a surviving spouse can file a claim to recover damages from the at fault parties (those that caused the death of the victim).  In many cases, any compensation received may be required to be shared with minor children.
  • If there is no surviving spouse, the children can file a claim to recover damages.  In the event that the children are minors, they may be represented by a court-appointed guardian.
  • If neither a spouse or a child survives the victim, then the parents of the victim can file a claim.
  • If neither a spouse, a child or parents survive the victim, the administrator of the estate can file a claim on behalf of the next of kin.
