Workers' Compensation Benefits

Depending on the nature and severity of your injuries, you may be eligible to receive one of four types of workers’ compensation income benefits.  Those benefits include:

Temporary Total Disability Benefits (TTD) – These benefits are paid weekly to workers who are injured on the job and are unable to return to any type of work.  These benefits total two-thirds of the injured worker’s average weekly wages, up to a $500 limit.  Injured workers with non-catastrophic injuries are limited to 400 weeks of benefits while those with catastrophic injuries can receive income benefits for the remainder of their lifetime or as long as they cannot work.

Temporary Partial Disability Benefits (TPD) – These benefits are paid weekly to workers who can return to work but do so in a job that pays less as a result of their on-the-job injury.  These benefits total two-thirds of the difference between the worker’s average weekly wages before and after the injury, with limits on the total benefits paid.  These benefits can be received for up to 350 weeks.

Permanent Partial Disability Benefits (PPD) – These benefits are paid weekly to workers whose on-the-job injury results in a permanent disability. The treating doctor will use AMA guidelines to assess and determine the percentage of your disability.  Payments are based upon the following formula:

Percent of your disability multiplied by the number of weeks the State Board of Workers' Compensation assigns to this percent of disability multiplied by the Temporary Total Disability rate

Death Benefits – These benefits are available to the deceased worker’s dependent spouse and minor children provided that the worker dies as the result of an on-the-job injury.  These benefits total two-thirds of the deceased worker’s average weekly wages at the time of the injury, up to a maximum of $500 per week.  Funeral-related expenses can be paid in full up to a total of $7,500.  In total benefit payments, a widowed spouse with no minor children is eligible to receive no more than a combined amount of $150,000 in weekly payments.  A deceased worker’s dependent minor child is eligible to receive weekly payments until he or she reaches the age of 18.

Medical Benefits – Medical treatment and rehabilitation services are generally covered by workers’ compensation but all treatments must be provided by a physician or healthcare provider that is listed on the employer’s panel of approved doctors.  The only exception to this rule is for immediate emergency care.
